This page explains how we process the personal data you provide through the www.mygiftie.app website and which cookies it uses. The processing of data of MyGiftie app users is described in the app's Terms and conditions of use.

1.Information for users

Who is responsible for processing your personal data?

The owner of MyGiftie, hereinafter the CONTROLLER, is responsible for processing the USER's personal data and informs the USER that this data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Spanish Organic Law 3/2018 of 5 December (LOPDGDD).

Why do we process your personal data?

To assist USERS of the website. The processing operations are:

  • Handling orders and requests, and answering queries or any other request made by the USER through the contact form or any of the contact methods made available on the CONTROLLER's website.
  • Handling requests relating to the USER's MyGiftie app account made from the website, such as validating their email address, resetting their password or deleting their account.
  • Protecting the website's forms against spam and automated use through Google reCAPTCHA.

On what grounds can we process your personal data?

Because the processing is lawful under article 6 of the GDPR as follows:

  • The CONTROLLER's legitimate interest: handling orders, requests, etc. at the USER's request and protecting the website against fraudulent use.
  • The performance of a contract to which the USER is a party: handling requests relating to their app account.

How long will we keep your personal data?

It will be kept for no longer than necessary to fulfil the purpose of the processing or for as long as legal requirements oblige us to keep it. When it is no longer needed, it will be deleted with appropriate security measures to guarantee its anonymisation or complete destruction.

Who do we share your personal data with?

No personal data will be disclosed to third parties except, where necessary to carry out the purposes of the processing, to our communications service providers (such as our email delivery service) and to Google, which provides the reCAPTCHA service. The CONTROLLER has signed with them the confidentiality and data processing agreements required by current privacy regulations.

What are your rights?

USERS have the following rights:

  • The right to withdraw your consent at any time.
  • The right to access, rectify, port and erase your data, and to restrict or object to its processing.
  • The right to lodge a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with current regulations.

2.Mandatory or optional nature of the information provided by the user

By ticking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form, USERS expressly, freely and unequivocally accept that their data is necessary for the provider to handle their request, the inclusion of data in the remaining fields being voluntary. The USER guarantees that the personal data provided to the CONTROLLER is truthful and is responsible for notifying any changes to it.

The CONTROLLER informs USERS that all data requested through the website is mandatory, as it is necessary to provide an optimal service to the USER. If not all the data is provided, there is no guarantee that the information and services provided will fully meet their needs.

3.Security measures

In accordance with current personal data protection regulations, the CONTROLLER complies with all the provisions of the GDPR and the LOPDGDD for the processing of the personal data for which it is responsible, and expressly with the principles described in article 5 of the GDPR, under which data is processed lawfully, fairly and transparently in relation to the data subject, and is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed.

The CONTROLLER guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established by the GDPR and the LOPDGDD in order to protect USERS' rights and freedoms, and has provided them with the appropriate information to exercise them.

4.About cookies

In accordance with Spanish Law 34/2002, of 11 July, on information society services and electronic commerce (LSSI), in relation to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, the General Data Protection Regulation (GDPR), and Spanish Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), all websites that use non-essential cookies must obtain the user's express consent before the user browses them.

7.How to manage cookies from your browser
